ICG says lawsuit over valley fill permits settled

CHARLESTON, W.Va. (AP) - International Coal Group says it's settled a lawsuit challenging federal water quality permits for an Appalachian surface mine.

Scott Depot-based ICG says the agreement announced Monday allows it to fill a fourth valley with excess material at its Thunder Ridge mine in Leslie County, Kentucky. In exchange, ICG says it's agreed to plant an extra 150 acres of hardwood trees and donate $50,000 to the Kentucky Fish and Wildlife Foundation.

ICG says the deal also covers three valley fills that it's already built.

The Sierra Club and Kentucky Waterways Alliance filed the suit after the Army Corps of Engineers issued the valley fill permits last year. Neither the Sierra Club nor the alliance immediately responded to requests for comment.
