
HENDERSON, KY - Two environmental groups are suing the U.S. Environmental Protection Agency over three proposed Kentucky power plants including one in Henderson. The suit, filed by The Sierra Club and the Evansville, Ind.-based Valley Watch, claims the government agency failed in its duty to curb air pollution by halting the progress of the projects. The plants named in the suit are the Cash Creek coal gasification plant in Henderson; Peabody and ConocoPhillip's NewGas coal gasification project in Muhlenberg County; and East Kentucky Power's Smith 1 plant in Clark County. The suit was filed this week in Washington and says the plants would be constructed in areas where EPA has "acknowledged does not meet Clear Air Act requirements."
